NOTICE OF ELECTION RESULTS
May 7, 2008
TO WHOM IT MAY CONCERN, and particularly to the electors of the Left Hand Water District of Boulder, Weld and Broomfield Counties, Colorado. An election was held on the 6th day of May, 2008.

At said election, the electors of the District voted for three Directors to serve a four-year term each on the Board of Directors of the District. Corey D. Heil, Bo Shaffer and Paul Schlagel were all reelected.

A Ballot Question was certified by the District:
SHALL THE EXISTING LIMITATIONS ON THE TERMS OF OFFICE CONTAINED IN ARTICLE XVIII, SECTION 11, OF COLORADO CONSTITUTION BE LENGTHENED FROM TWO CONSECUTIVE TERMS OF OFFICE (8 YEARS) TO THREE CONSECUTIVE TERMS OF OFFICE (12 YEARS) AS APPLIED TO THE LEFT HAND WATER DISTRICT’S BOARD OF DIRECTOR’S?

April 23, 2008
TO WHOM IT MAY CONCERN, and particularly to the electors of the Left Hand Water District of Boulder, Weld and Broomfield Counties, Colorado. NOTICE IS HEREBY GIVEN that an election will be held on the 6th day of May, 2008, between the hours of 7:00 a.m. and 7:00 p.m. The Board of Directors of the District has designated the following polling place:

Mt. View Fire Protection District
8500 Niwot Road Fire Station, Niwot, CO 80544

At said election, the electors of District shall vote for Directors to serve the following terms of office on the Board of Directors of the District:

Three Directors for FOUR-Year Terms

NOTICE IS FURTHER GIVEN that an eligible elector of said District for the purpose of said election is a person registered to vote pursuant to the "Colorado Uniform Election Code of 1992"; and (I) who has been a resident of the District for not less than thirty (30) days, or (II) who, or whose spouse, owns taxable real or personal property within the District, whether said person resides within the District or not or (III)a person who is obligated to pay taxes under a contract to purchase taxable property within the District shall be considered an owner of taxable property for the purpose of qualifying as an eligible elector.

NOTICE IS FURTHER GIVEN that applications for and return of mail-in voter ballots may be filed with and replacement ballots may be received from Kim Lane, Designated Election Official of the District, at 6800 Nimbus Road, Longmont, CO 80503, between the hours of 8:30 a.m. and 4:30 p.m., until the close of business on the Friday immediately preceding the regular election (Friday, May 2, 2008). 303-530-4200 Telephone.

FACT SHEET REGARDING MAY 6, 2008 ELECTION
March 4, 2008
On Tuesday, May 6, 2008, the Left Hand Water District will be conducting its bi-annual general election. At that election, the voters of the District will be asked to vote for three directors and to approve or reject one ballot question.
Then names of the directors who are running for each position on the Board of Directors to server four year terms are:

Corey D. Heil – Director District 4
Bo Shaffer – Director District 5
Paul Schlagel – Director District 6

The current Board of Directors has also referred a ballot question to the voters at this election, such question will ask:

“SHALL THE EXISTING LIMITATIONS ON THE TERMS OF OFFICE CONTAINED IN ARTICLE XVIII, SECTION 11, OF THE COLORADO CONSTITUTION BE LENGTHENED FROM TWO CONSECUTIVE TERMS OF OFFICE (8 YEARS) TO THREE CONSECUTIVE TERMS OF OFFICE (12 YEARS) AS APPLIED TO THE LEFT HAND WATER DISTRICT’S BOARD OF DIRECTORS?”

Section 1-45-117(1)(b), Colo. Revised Statutes, allows the District to prepare and disseminate a “factual summary, which shall include arguments both for and against the proposal, on any issue of official concern before the electorate.” The following is a factual summary of the arguments both for and against:

Pros:

  1. The District’s Board of Directors deals in technical water and utility issues related to the operation of a water system, not in political issues on which citizens have strong opinions
  2. It takes time for directors to gain the expertise in matters of water rights and system management, and such expertise is lost if only two terms of service are allowed
  3. Voters approved term limits as an amendment to the ColoradoConstitution in 1996, but the amendment allows voters to eliminate term limits altogether. This BallotQuestion seeks only to add one additional four-year term, not eliminate term limits altogether


Cons:

  1. Term limits provide a check on complex the decision making power of directors. Having shorter term
    limits lessen the public’s concern that politically motivated decision making might occur and become entrenched
  2. Current term limits (two four-year terms) could result in more candidate choices for the voter and opportunities for new board members to bring new ideas to the Board
  3. The original amendment to the Colorado Constitution in 1996 approved term limits of two-terms, so there is the presumption that all terms should be so limited

Director District elections are held every two years.
Left Hand Water District will hold its next regular election in May 2008, at which time Directors representing Director Districts Four, Five and Six are up for election.

Who can be a candidate ?
Candidates must live within the Director District they will represent. See the Director District map to see which Director District you live in. A Call for Nomination notice is published in the Longmont Daily Times Call no more than 90 days and not less than 75 days prior to an election.

Who can vote ?
Any registered voter (property owner or renter) residing or owning property anywhere in the Left Hand Water District can vote for one director for each of the director districts. You can vote for any director, even if your director is not up for election, and all voters in the District can vote for candidates for all of the open positions.

How do I vote in this election ?
For the convenience of its electors, the District holds elections via polling place (s) on election day or Mail-In Voter Ballots (formerly Absentee Ballots). The Mountain View Niwot Fire Station is generally the District’s designated polling place. Mail-In Voter Ballots are available by contacting the Designated Election Official at 303-530-4200, or you can download the application. However, you must hand deliver, fax or mail your completed Mail-In Voter Ballot application to the Designated Election Official. We cannot accept them via email.

How do I know when there is going to be an election ?
Our Notice of Election is published in the Longmont Daily Times Call newspaper in April, prior to an election. A Notice of Election is posted at the District office, Niwot Post Office and Mountain View Fire Station.
